Welcome to Run the 1s (the "App"). These Terms of Service ("Terms") govern your use of our mobile

application and services. By using Run the 1s, you agree to these Terms.

## 1. Acceptance of Terms

By creating an account or using the App, you agree to:

## 2. Eligibility

You must be:

- **13 years or older** to create an account

- **18 years or older** to participate in paid tournaments or use payment features

- Able to form a binding contract under applicable law

By using the App, you represent that you meet these requirements.

## 3. User Accounts

### Account Creation

- You must provide accurate, complete information

- You are responsible for maintaining account security

- You may not share your account with others

- You must notify us immediately of unauthorized access

### Account Termination

- You may delete your account at any time

- We may suspend or terminate accounts that violate these Terms

- Termination does not excuse payment obligations

## 4. User Conduct

You agree NOT to:

- ❌ Harass, bully, or threaten other users

- ❌ Post inappropriate, offensive, or illegal content

- ❌ Cheat, manipulate game results, or exploit the App

- ❌ Impersonate others or create fake accounts

- ❌ Spam, advertise without permission, or send unsolicited messages

- ❌ Hack, reverse engineer, or attempt to breach security

- ❌ Use bots, scripts, or automated tools

- ❌ Violate intellectual property rights

**Violation may result in account suspension or permanent ban.**

## 5. Content and Intellectual Property

### Your Content

- You retain ownership of content you upload (photos, videos, messages)

- You grant us a license to use, display, and distribute your content within the App

- You represent that you own or have rights to all content you post

- We may remove content that violates these Terms

### Our Content

- The App, including design, features, logos, and code, is owned by Run the 1s

- You may not copy, modify, distribute, or create derivative works

- "Run the 1s" and related trademarks are our property

## 6. Game Features and Statistics

### Game Recording

- Games must be validated by both players

- You agree to record accurate scores

- Disputed games will be reviewed and may be voided

- We reserve the right to adjust statistics for violations

### ELO Ratings

- ELO ratings are calculated algorithmically

- Ratings may be adjusted to correct errors or violations

- Ratings are for informational purposes and do not guarantee skill level

### Tournaments

- Tournament rules are set by organizers

- Entry fees are non-refundable unless the tournament is cancelled

- Prize distributions are subject to tournament terms

- We are not responsible for disputes between players

## 7. Payment Terms

### Tournament Entry Fees

- Fees are processed through Stripe

- Fees are non-refundable except in case of cancellation

- Organizers set prize pools and payout terms

- We charge a service fee on transactions

### Creator Payouts (Stripe Connect)

- Creators must connect a Stripe account to receive payments

- Payouts are subject to Stripe's terms and processing times

- Tax reporting is the creator's responsibility

- We are not responsible for Stripe payment issues

### Refunds

- Tournament entry fees are non-refundable

- Refunds may be issued at our discretion for cancelled events

- Contact support@run1s.com for refund requests

## 8. Third-Party Services

### Social Media Integration

- Connecting Instagram or other services is optional

- You must comply with their terms of service

- We are not responsible for third-party service issues

- You may disconnect at any time

### App Stores

- Downloads through Apple App Store or Google Play are subject to their terms

- We do not control app store policies or pricing

## 10. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

- Uninterrupted or error-free operation

- Accuracy of content, statistics, or ratings

- Security against hacking or data loss

### LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- We are not liable for indirect, incidental, or consequential damages

- Our total liability is limited to the amount you paid in the last 12 months (or $100 if higher)

- We are not responsible for user conduct, tournament disputes, or third-party actions

### PHYSICAL INJURY

Basketball is a physical sport. You acknowledge:

- Risk of injury when playing games organized through the App

- You participate at your own risk

- We are not responsible for injuries

- You should consult a doctor before physical activity

## 11. Indemnification

You agree to indemnify and hold harmless Run the 1s, its owners, employees, and affiliates from any claims,

damages, or expenses arising from:

- Your use of the App

- Your violation of these Terms

- Your violation of others' rights

- Content you post

## 12. Dispute Resolution

### Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

### Arbitration

- Disputes will be resolved through binding arbitration

- Arbitration will be conducted in Ontario, Canada

- You waive the right to participate in class actions

### Exceptions

You may still pursue claims in small claims court or seek injunctive relief.

We may update these Terms at any time. Changes will be effective when posted. Continued use of the App

after changes constitutes acceptance.

## 14. Termination

### By You

You may terminate your account at any time through:

- In-app settings → Delete Account

### By Us

We may terminate or suspend your account if you:

- Violate these Terms

- Engage in fraudulent activity

- Remain inactive for extended periods

### Effect of Termination

- You lose access to your account and data

- Outstanding payment obligations remain

- Certain provisions (liability, indemnification) survive termination

## 15. Miscellaneous

### Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Run the 1s.

### Severability

If any provision is found invalid, the remaining provisions remain in effect.

### No Waiver

Our failure to enforce any right does not waive that right.

### Assignment

You may not assign these Terms. We may assign them to affiliates or successors.

### Force Majeure

We are not liable for delays or failures due to circumstances beyond our control (natural disasters, wars,

pandemics, internet outages).
